Terms of Service

These Terms of Service (the “Terms”) govern access to and use of the ForenSync platform, websites and related services (the “Service”). By activating an account or otherwise using the Service you agree to these Terms on behalf of yourself and the organisation you represent. If you do not agree, do not use the Service.

ForenSync is a professional tool for structured forensic investigation and analytical reasoning. It is provided to organisations and the investigators they authorise, and is not intended for consumers.

Access to the Service is by invitation only. Accounts are provisioned by an organisation administrator who invites named users; there is no public self-service sign-up. You may only use an account that has been issued to you, and you may not share your account or credentials.

During account activation you will be asked to review and accept these Terms and our Privacy Policy. Your acceptance is recorded. You must be authorised by your organisation and legally able to enter into these Terms in order to activate an account.

The Service guides investigators through a structured, phase-gated methodology and provides supporting tools such as evidence management, scenario analysis, AI-assisted methodological reflection, and report generation. Features may change over time as the Service is improved.

The AI reflection feature raises methodological questions to help you examine your own reasoning. It is advisory only: it does not analyse evidence, reach conclusions, assign scores, or make determinations. All analytical judgements remain yours.

You are responsible for keeping your credentials confidential and for all activity under your account. Where your organisation requires it, you must enable and maintain two-factor authentication. Notify your administrator or ForenSync promptly if you suspect any unauthorised access.

You agree not to:

• use the Service unlawfully, or to process data you are not authorised to process;
• attempt to access accounts, organisations or data that are not yours;
• interfere with, disrupt, probe, or reverse engineer the Service or its security; or
• upload malicious code or use the Service to infringe the rights of others.

As between the parties, your organisation owns the case data and other content it submits to the Service (“Customer Data”). We process Customer Data on your organisation’s behalf to provide the Service, in accordance with our Privacy Policy and any data processing agreement in place. We treat Customer Data as confidential.

ForenSync and its licensors retain all rights in the Service, including its software, design, and methodology. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service while your account is active. You retain your rights in Customer Data.

Access is provided under the subscription plan agreed with your organisation, which determines the number of user seats and the fees payable. Fees are billed as described at the time of purchase. Except where required by law, fees are non-refundable.

We work to keep the Service available and secure but do not guarantee uninterrupted operation. We may modify, suspend, or discontinue parts of the Service, and may suspend or terminate access that breaches these Terms or that poses a security or legal risk.

The Service documents an investigative reasoning process. Its outputs are non-diagnostic and non-adjudicative: they are not a verdict, a determination of guilt, or legal advice. The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law.

To the fullest extent permitted by law, ForenSync will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill. Nothing in these Terms limits liability that cannot be limited under applicable law.

These Terms are governed by the laws applicable to ForenSync’s place of establishment, without regard to conflict-of-law rules. Disputes will be subject to the competent courts of that jurisdiction, unless mandatory law provides otherwise.

We may update these Terms from time to time. When we make material changes we will update the “last updated” date and, where appropriate, ask you to accept the revised Terms. Continued use of the Service after changes take effect constitutes acceptance.
